Log 4 - Essay Example Upon my arrival, I met the nurse in charge, and she assigned me to a case involving the preparation of a patient for the operation room. The nurse in charge requested the Registered Nurse (RN) in charge of the Operation Room (OR) schedule to oversee my undertakings. Jerriann, the RN, was in charge of the most recent OR case that was scheduled for 11.30 a.m. The first task entailed preparing a patient that was in the recovery room for the operation room. In order to begin working on the patientââ¬â¢s preparation we had to wait for the whole team to arrive. The anesthetist first talked to the patient before we could initiate the preparation. My role as a CNS in the preparation for OR entailed ensuring that the patientââ¬â¢s safety was upheld during the transfer process into the OR. The role of ensuring patient safety as a CNS is important in shaping the direction of managed care outcomes, therefore, I had to make sure that protocols of transfer to the OR and preparation were obse rved. As part of this task, I had to carry out double checks to ensure that the IV lines were appropriately positioned, the side rails were up and the indwelling catheters were secure and well knotted to avoid any dislodge. After completion of the checks and observation of transfer protocols, the patient was safely transferred to the operation room. Once safely positioned in the operation room the nursing team began preparing the patient to receive spinal anesthesia. The process was quite challenging because the nursing team took almost one hour to properly insert the needle. The challenge was due to the fact that there was some resistance encountered during the insertion process. However, the process was finally successful on a second attempt. Everything was set to go after the completion of the anesthetistââ¬â¢s process, and the operation team started operating on the patient. Children Society, 21(5), 390-396). Doctors agree that there are two primary factors in creating obese children. First, the children and teenagers are not eating the right kinds of foods. Second, Americas children are getting less and less exercise on a daily basis. The effects of childhood obesity can be very serious and often include both physical and psychological effects on the lives of the children who are affected. Children that are obese go through a lot of different situations that allow them to become more prone to a mental illness. There are several causes for childhood obesity. Technology plays a big role in childhood obesity in todayââ¬â¢s society. The biggest cause of childhood obesity is the lack of parenting. Childhood obesity can be prevented. It is best to prevent it from happening than to have to obtain a treatment for it. Childhood obesity plays a major impact on children up into adulthood and even has a role in the decisions an individual makes. Children that are obese have physical limitations. Most children usually take a liking into some type of physical activity whether it is playing a sport or just running around the yard for fun. Those actions are the normal expected actions of any child by both society and most of all parents. It is very difficult for a child when he or she is excluded from or limited to a certain amount of a physical activity due to weight related issues. Some children do not take rejection very well in any way, shape, or form. Obese children fall subject to a variety of physical and perceived physical barriers. Living an active lifestyle is difficult for an obese child. Obese children often go through a cycle of inactivity and poor health which creates more and more of a problem. Some of these problems that inactivity and poor health cause include asthma, joint pain and increased musculoskeletal stress, orthopedic problems, and psychosocial morbidity. When it comes to physical activity it is common in obese people to have the feeling of being too heavy in order to perform any physical activities. It is almost impossible for an obese child to just jump into heavy doses of high intensity physical activity. It is preferred that an obese child take a slow approach with light low-intensity physical activities in order to reach a better health. Obesity is associated with early mortality and has overtaken smoking as the health problem with the greatest impact on quality of life, mortality, and morbidity (Canadian Journal Of Psychiatry, 57(1), 13-20). The physical effects are often similar to the effects that are faced by adults who are obese, the psychological effects can sometimes be much, much worse because of the negative impact these issues can place on a still developing child. Mental illness is a significant factor that associates with obesity. Most people hear the term obese and mainly think of it as a physical condition. Obesity can be both physical and mental. From a behavioral perspective, mental illness is often characterized by a symptom profile that impacts energy, appetite, and motivation, and is more likely to be associated with unhealthy lifestyle factors, such as smoking, alcohol, and drug use. This makes exercise and healthy nutritional choices more difficult to implement (Canadian Journal Of Psychiatry, 57(1), 13-20). There is on individual on the face of this earth that smokes, drinks, or uses any recreational drugs that can still perform heavy doses of high intensity activities on a regular basis. The most common mental condition that is found it obese children is low self-esteem. Most people do not realize how much detrimental comments affect these children. The majority of children who are obese are faced with constant and persistent ridicule. The sad part about this situation is that the ridicule does not come from just other children but adults as well. The results of constant ridicule may lead a child to believe that they are worth anything which makes them feel as if there is no reason for them to even try to amount to anything. When anyone has that belief in their head it blocks that person from not caring about their life as a whole. This leads to a variety of problems all on its own. Success is something that may never be strived for by a child or adult that loses the mental battle that comes along with obesity. Studies show that children that are obese are at a higher risk of emotional problems that often carry over into adulthood. The study also reported that obese boys and girls with low self-esteem had higher rates of loneliness, sadness and nervousness. These children were more likely to smoke and drink alcohol compared with obese children with normal self-esteem. Depression, often an outcome of low self-esteem, affects as many as 750,000 teens in the U. S. (Source: Pediatrics, Childhood Obesity and Self-Esteem, January 2000. ) Untreated depression is recently passed upon but is a cause and effect of childhood obesity. Technology is at an all-time high. The technological age has resulted in children spending prolonged hours in front of television (TV) and computer screens. Lots of children are more interested in the technology than the usual interest of physical activity. Television shows, the internet, mobile phones, and video games occupy most childrenââ¬â¢s attention for great amounts of time every day. The rapid growth of technology is grasping the attention of the youth. The new lifestyle that has taken over the livesââ¬â¢ of the youth leaves little time for them to exercise. This lifestyle reduces the amount of physical activity and it is far from the lifestyle that their parents may have enjoyed many years ago. Parks are not as used as they often were and playgrounds are not as busy as they used to be. All of that is replaced with computers, laptops, handheld games, and anything that involves little or no physical movement. Health researchers suggest no television at all for children aged less than two years and not more than two hours of viewing for children aged more than two years. Most importantly itââ¬â¢s unhealthy to provide your child a separate television or computer in his room. More time spent on television and computer playing video games or computer games means less time spent on healthy physical activities. Nintendo did have one breakthrough when they the WII system to the world. This games forces children to get up out of their seats and move in order to play the game. Children are limited to the use of certain technology while at school, but at home the use of technology is at the discretion of the parent. Most children would rather sit inside all day with technology and constantly intake major calories without burning any. On a daily basis this can add some major pounds and create bad habits. Technology is great to have but it must not be abused by any individual. More than 25 million students use the National School Lunch Program (NSLP) daily, while approximately 7 million utilize the National School Breakfast Program (NSBP) daily. The public school systems have started programs that assure that each child is being fed healthy foods and that each child has the required physical activity to go along with an education. School programs that encourage physical activity are important for increasing childrens energy expenditure; because children are less likely to participate in physical activity in the absence of adult supervision (Am J Public Health. 001;91:618-620). The education and health of children are prominent considerations in the 21st century. Schools have always had a traditional focus on increasing literacy and numeracy proficiency in children, but now they are increasingly being tasked with preventing obesity as well. Regular physical activity is directly implicated in the prevention of childhood obesity; there is evidence, however, that it may also benefit cognitive development(American Journal Of Public Health, 102). Physical education (PE) in schools is an ideal vehicle by which to promote physical activity in children because it is available to all children, and teachers have the opportunity to integrate it into the overall education process (American Journal Of Public Health, 102). The public school system has a major impact on the determination of what children are exposed to. Starting the concern for kidââ¬â¢s health at an early age is a head start for the future. The impact on the lives of kids early may be the influence each child needs in order to make healthy decisions in the run of life. Parenting is the best prevention method that exists today for childhood obesity. Parents may miss or just donââ¬â¢t ever think about the actions that they perform around their kids. Children are followers, so most kids are reflections of their parents. Parents can help prevent obesity by having the knowledge of nutritional facts, by the food available in the household, by the parentsââ¬â¢ eating habits, encouragement of activity, parentsââ¬â¢ activity pattern, the current weight of the parent and by monitoring the time spent with the new age technology that requires little or no physical movement. Old sayings often make people believe that obesity is genetic. This is not a true statement. Every adult has control over what their physical appearance would be. Children need a good role model physically. Parents are the perfect role models for this job. Parents have the biggest and most effect on the lives of their children. Parents should be very concerned with the health of their children at a very early age. Some of the schools are now offering to the parents a few courses that are very direct about proper nutrition and exercise. Also the lunch menu for the week is sent home in advance to inform the parents of what type of foods and snacks that their children are consuming on a daily basis. People are still in belief when it comes to kids that it is ok for them to eat anything. Proper nutrition plays a very big role in the development of a child , both physical and mental. Keeping the kids in the habit of eating healthy has very great benefits in the long run. The mixture of fast food diets along with sedentary lifestyles is creating a generation of children who are facing very adult health issues like high cholesterol, diabetes and heart disease. Preventing obesity, or even slowing the dramatic rate of increase in obesity prevalence, will probably require societal changes which facilitate the modification of diet and physical activity by children and their families (Childhood Obesity: An Overview. Children Society, 21(5), 390-396). Technology will continue to rise rapidly. Most children are more attracted to prolonged hours of sitting with some type of technology rather than to get up and be active. The society revolves around the use of technology, both mobile and stationary. Public schools are implementing new programs that will reflect the proper nutrition and exercise required for each child. Schools also have the potential to influence students beliefs and attitudes regarding nutrition and weight control. Parents are the best prevention method against obesity. Parents have the control over each and every cause of childhood obesity. Every child looks up to their parent and someday may want to follow in their footsteps. The result of the footsteps each child takes is heavily depended upon the parent.

Claude Monet Claude Monet made the art community address a revolutionary type of art called impressionism. In a style not previously before painted, impressionism captured a scene by using bright colors with lots of light and different shades to create the illusion of a glance. The traditional method of working in a studio was discarded and the impressionist artists carried any needed supplies with them into the countryside and painted the complete work outside. The manufacture of portable tin tubes of oil paints as well as the discovery of ways to produce a wider range of chemical pigments allowed artists to paint in a way unimaginable before this period in time (Stuckey 12). Monet and others, such as Pierre Auguste Renior, Paul Cezanne, Edgar Degas, Berthe Morisot, Edouard Manet, Camille Pissarro, and Alfred Sisley, took this style of art to a new level never seen before. Claude Monet was born on November 14, 1840, in Paris, France and moved to LeHavre with his family at age five (Skira 21). As a schoolboy, Monet doodled in the margins of his books. His artistic career began by drawing caricatures of his schoolmasters distorting their faces and profiles outrageously. By the time he was fifteen, people would pay ten or twenty francs for one of his drawings (Skira 22). In 1857 Monet met the famous landscape painter Eugene Boudin, who was in the LeHavre area. Boudin noticed Monet's talent when he saw his caricatures. Boudin took Monet to the countryside and showed him what it was to paint something of art. Monet was quoted as saying, "it was as if a veil was torn from my eyes and I understood what painting should be (Stuckey 186)." Monet used the money earned from selling his caricatures to pay for a trip to Paris in 18... ...f 86 and after outliving many of his fellow artists, Claude Monet died leaving a legacy of works devoted to the way he saw the world. Everything in life was a magnificent symphony of colors in Monet's eyes. He brought to canvas the technique of preserving one particular moment in time by developing the style of presenting the first impact of what an eye would capture in one glance before the brain had the chance to create the exact image of the subject in the mind. Today over 2,000 oil paintings and 600 pencil sketches are exhibited in museums, galleries, and with private art collectors (Stuckey 10) allowing the world to appreciate Monet's vision forever. Injustice anywhere is a threat to justice everywhere Essay
Injustice refers to either the absence or the exact opposite of justice. The term is applied either in reference to a particular event or even a larger incident. Injustice throughout society today is heard a lot about. People hear about major injustices all the time especially now media access is a lot easier. Many people can also come together and confront one another to either support or contradict these transgressions. This can also be contemplated throughout innumerable historical events and even ones that encourage Martin Luther King Jr.ââ¬â¢s proclamation that any place with injustice means it is a portent everywhere else. Children both men and women are held in slavery over the course of the entire trans-Atlantic slave trade. The National Underground Railroad Network to Freedom Act of 1988 directed the National Park Service to commemorate and honor the history of the Underground Railroad. The Underground Railroad was the resistance to enslavement through escapes and flights throughout the Civil War. It also referred to the efforts of enslaved African Americans to gain their equality by escaping bondage. Wherever slavery existed, there was some sort of effort in escaping. While most completed their journey of escaping unassisted, each subsequent decade in which slavery was legal in the United States saw an accumulation in active efforts to reinforce these escapes. The decision to assist a freedom seeker was quite an experience. However, in other places, particularly after the Fugitive Slave Act of 1850, the Underground Railroad was surprisingly organized and even deliberate; seekers spread out into different directions to discuss the important movement in American History as an examination of the areas in which people were enslaved. The power of the word ââ¬Å"injusticeâ⬠results in many people abusing it and trying to apply it to situations where uninformed people will react by taking their side of the altercation. In the short passage ââ¬Å"Protecting Freedom of Expression on the Campusâ⬠, Derek Bok discusses the problem of attempting to reconcile the rights of free speech along with the desire toà avoid racial tension. Derek begins his explanation by using two of his students, one who hung up a confederate flag in public view in Harvard along with having one who protested that same situation by hanging swastika. Oppositions may state that anything that may have been a threat or harm to human life should definitely contain limitations and restrictions. Bok stated how extraordinary perspectives argued by various student groups on the campus were also adding on to express how unique student groups suggested revolving this issue that Bok continued to explain the certain campuses resolving around sim ilar dissensions. ââ¬Å"Freedom is never voluntarily given by the oppressor; it must be demanded by the oppressed.â⬠A nation where most citizens are free to choose their careers, their homes and jobs can be both profitable and content. Having freedom being given freely to the oppressed which means they must fight for their own rights. Most of the time an oppressor benefits from its oppression and the oppressed has to be the first one to set an example of a better situation and then beginning the process of releasing the continuity of oppression. At any rate, it may not be the freedom that ââ¬Å"freedom isnââ¬â¢t freeâ⬠but it definitely is the basis for it. There is freedom in both social and political senses especially when others abstain from interfering with certain activities that they attend. Freedom in the sense of the inborn capacity to act as people rather than machine figures portray the fact that freedom is free. And that peopleââ¬â¢s obligations are mostly under a negative connotation rather than a positive connotation in respect to emancipation. In the book, ââ¬Å"The System of Liberty: Themes in the History of Classical Liberalismâ⬠by George H. Smith, he discusses the difference between the positive and negative freedom as a huge part of the division between the ââ¬Å"old liberals.â⬠And how the newer liberal comprehension of freedom would require people to do more work instead of initiating force against others because newer liberal-T.H. Green believed that nobody could be free who lacked certain materials. And in order for them all to be free, everybody would be required to submit to the statesà demands in the variety forms of taxations and regulations of consensual negotiations. However, oppositions may state that protecting oneââ¬â¢s negative social freedom requires usage of scarce resources and in that sense, freedom is not free. Because liberals have spent a decent amount of time proving that new liberalism is founded on a contradiction, that the freedom of one postulates aggressive force upon one another because freedom cannot directly be accustomed; therefore, resulting in people having to work for their liberties. Freedom is not to be given freely because the rights that are already given to us are both significant and immeasurable. In the novel, ââ¬Å"To Kill a Mockingbirdâ⬠by Harper Lee, Atticus is appointed by the court to defend Tom Robinson-an African American who had been accused of raping a young White woman. Even though many of Maycombââ¬â¢s citizens disapproved, Atticus continued to defend Tom. And that resulted in having other children taunt two children Jem and Scout by calling them a ââ¬Å"niggerâ⬠for the actions that they have made. Scout was tempted to stand up for his fatherââ¬â¢s honor by fighting even though Scoutââ¬â¢s father told her not to. It was also not the proper way to deal with a situation like this so her father did not want his daughter to get into trouble even though she was not treated as an equal. Though others may disagree and state that it was completely Scoutââ¬â¢s fathersââ¬â¢ decision to defend the African American, he deserved the decision he made. Scoutââ¬â¢s father stood up for Tom Robinson because he knew that he was innocent and he did what he believed was right. And in the end, Tom Robinson gained his freedom by trying to escape from prison because he knew he did not belong there and ended up getting shot. That was his definition of gaining his freedom and it was definitely not free since he practically sacrificed his life.

Effects of Online Games to the Students Essay
As time passes by, technology continues to evolve. Because of technology, new things were created that sustains and lightens human work. Computers were created because of technology. Computers were the greatest thing ever invented by man itself. In the modern age, computers have become a part of manââ¬â¢s life. Almost all the things around us were made by computers with the aid of modern machines. From the edited books, design, special effects in movies, and televisions etc., were all made by computers. Along with the evolution of technology, computers continue to upgrade as well until the time that computer has now become a part of manââ¬â¢s everyday life that are hooked to computers. Computers can now edit documents to your PC, play mini games, search information you need using the internet, save documents to your PC and play online games. Itââ¬â¢s like an all-in-one gadget that can do all the things you want anytime you need it. From 1990 to the present year, online games had a big impact to us especially teenagers. Online games have many genres, including FPS games, MMORPG, Casual games and multiplayer games. A game will become an online game if it involves in using a computer or a series of computers with one player in each computer to battle it out with other players using the Internet depending on the game genre. Games have always been a popular pastime, but with the advent of computer games they have become even more pervasive. Despite all this progress, we may still stop and ask what makes a game. Because computer games are a subset of games, everything we can say about games in general applies also to them. Nevertheless, computer games are also computer programs, and, therefore, lessons learnt in software construction can be applied to them. A third perspective to computer games is subjective and it concerns finding out what features the players expect from a computer game. A dictionary defines ââ¬Ëgameââ¬â¢ as ââ¬Ëa universal form of recreation generally including any activity engaged in for diversion or amusement and often establishing a situation that involves a contest or rivalry. A computer game is carried out with the help of a computer program. This definition leaves us some leeway, since it does not implicate that the whole game takes place in the computer. Gaming has gained such popularity that it could now be considered as practically mandatory. Being great and skilled at playing these video games gives individuals several social benefits. Based on studies and research conducted, gaming has become one of fastest growing in the entertainment sector. It has surpassed the achievements of full-length films, revenue-wise. Gaming is truly a social activity and the mere act of playing games has been directly linked in the establishment of relationships as well as social hierarchies throughout history. Games could be engrossing for many different reasons. Online games or video games are those that could be played over some kind of computer games to those games that incorporate complex computer graphics with virtual worlds that are populated by a lot of players simultaneously. A lot of the video games today have their own associated online communities and these make online games a true social activity that goes beyond the single player games. Online gaming has really made it mark, being an innovative feature of the Internet which would surely be staying and developing in the many, many years to come. In the past, only those who were willing to spend expensive fees and put up with a hard setup process made up online gaming communities. Today, though, a lot of people are getting into, even the younger generation, which raises some negative implications as well on its effect on students. Background of the Study Development of technology brought many things that people do not have many years back. One of those things was online gaming that was provided by the internet. Online Gaming is one of the widely used leisure activities by many people. Teenagers who were playing these online games said that they were playing online games just for fun, to keep away from the heat of the sun, without knowing that there were a lot of effects of playing these games that are more than what they think. Playing online games enabled the mind of the players to be more active, especially those puzzled based-games. It helps the players to come up with decision tight situations, especially those adventure games that kept the players to be alert, active and strategic. Playing online games made the players experience different feelings because it was as if the players really are the one taking the challenges. Despite those benefits, playing online games also brought negative effects, it requires much of the playerâ â¬â¢s time, leaving school activities and homework unattended. The Internet has pervaded our society rapidly. It has been major means of communication, used for the exchange of information, for news and for shopping, and now one of the most popular online contents is the game. Online gaming was mainly concentrating on gaming over the internet, where an amount of money is bet on the prospect of a player or group of players winning. Those types of games were usually referred to by the websites as games of skill, and include chess, backgammon and solitaires. Online gaming is a technology rather than a genre, a mechanism for connecting players together rather than a particular pattern of game play. Online games are played over some form of computer network, now typically on the Internet. Some of the advantages of playing online games are, the ability to connect to multiplayer games, although single-player online games are quite common as well, and the ability to build the confidence of the individual in the game that they have used to play. Some of the disadvantages also on playing online games were; the students may be too much hooked on this game and may have insufficient time to study their lessons that their teachers taught them. In the year 2008, most high school students have played a lot of online gaming, and it is very popular. Online games were inspired by video games. The first video and computer games, such as NIMROD (1951), OXO (1952), and Space war! (1961) were for one or two players sitting at a single computer which was being used only to play the game. Later in the 1960s, computers began to support time-sharing, which allowed multiple users to share use of a computer simultaneously. Systems of computer terminals were created allowing users to operate the computer from a different room than where the computer was housed. Soon after, Modem links further expanded this range so that users did not have to be in the same building as the computer; terminals could connect to their host computers via dial-up or leased telephone lines. With the increased remote access, ââ¬Å"host basedâ⬠games were created, in which users on remote systems connected to a central computer to play single-player, and soon after, multiplayer games. Online games can give us positive effects and benefits to us students, but on the contrary we notice that the students spend more time in playing online games rather than it in such a productive way. Online gaming is an emotionally draining and time-consuming activity. To create more time for the computer, gaming addicts neglect sleep, diet, exercise, hobbies, and socializing. They let their own health go as they do not get the proper rest and nutrition they need. They may suffer a number of health problems from back strain, eye strain, carpal tunnel syndrome, and repetitive stress injury. In this study, sophomore students of College of Business in Polytechnic University of the Philippines (PUP) are the respondents. We chose them as our respondents because we see that most of them are addicted in online games. They are given an opportunity to answer and evaluate themselves whether they can handle playing online games and at the same time can do other important activities. It is for the reason that we are interested in taking a more serious look in the effects of online games particularly to the sophomore students of Polytechnic University of the Philippines (PUP) who are the role models of freshmen students. Theoretical Framework Game theory is a study of strategic decision making. More formally, it is ââ¬Å"the study of mathematical models of conflict and cooperation between intelligent rational decision-makers.â⬠An alternative term suggested ââ¬Å"as a more descriptive name for the disciplineâ⬠is interactive decision theory. Game theory is mainly used in economics, political science, and psychology, as well as logic and biology. The subject first addressed zero-sum games, such that one personââ¬â¢s gains exactly equal net losses of the other participant(s). Today, however, game theory applies to a wide range of class relations, and has developed into an umbrella term for the logical side of science, to include both human and non-humans, like computers. Classic uses include a sense of balance in numerous games, where each person has found or developed a tactic that cannot successfully better his results, given the other approach. Early discussions of examples of two-person games occurred long before the rise of modern, mathematical game theory. The first known discussion of game theory occurred in a letter written by James Waldegrave in 1713. In this letter, Waldegrave provides a minimax mixed strategy solution to a two-person version of the card game le her. James Madison made what we now recognize as a game-theoretic analysis of the ways states can be expected to behave under different systems of taxation. Around this same time, John Nash developed a criterion for mutual consistency of playersââ¬â¢ strategies, known as Nash equilibrium, applicable to a wider variety of games than the criterion proposed by von Neumann and Morgenstern. This equilibrium is sufficiently general to allow for the analysis of non-cooperative games in addition to cooperative ones. Game theory experienced a flurry of activity in the 1950s, during which time the concepts of the core, the extensive form game, fictitious play, repeated games, and the Shapley value were developed. In addition, the first applications of Game theory to philosophy and political science occurred during this time. In 1965, Reinhard Selten introduced his solution concept of sub game perfect equilibria, which further refined the Nash equilibrium. In 1967, John Harsanyi developed the concepts of complete information and Bayesian games. Nash, Selten and Harsanyi became Economics Nobel Laureates in 1994 for their contributions to economic game theory. In the 1970s, game theory was extensively applied in biology, largely as a result of the work of John Maynard Smith and his evolutionarily stable strategy. In addition, the concepts of correlated equilibrium, trembling hand perfection, and common knowledge were introduced and analysed. In 2005, game theorists Thomas Schelling and Robert Aumann followed Nash, Selten and Harsanyi as Nobel Laureates. Schelling worked on dynamic models, early examples of evolutionary game theory. Aumann contributed more to the equilibrium school, introducing an equilibrium coarsening, correlated equilibrium, and developing an extensive formal analysis of the assumption of common knowledge and of its consequences. In 2007, Leonid Hurwicz, together with Eric Maskin and Roger Myerson, was awarded the Nobel Prize in Economics ââ¬Å"for having laid the foundations of mechanism design theory.â⬠Myersonââ¬â¢s contributions include the notion of proper equilibrium, and an important graduate text: Game Theory, Analysis of Conflict (Myerson 1997). Hurwicz introduced and formalized the concept of incentive compatibility. Modern game theory began with the idea regarding the existence of mixed-strategy equilibria in two-person zero-sum games and its proof by John von Neumann. Von Neumannââ¬â¢s original proof used Brouwerââ¬â¢s fixed-point theorem on continuous mappings into compact convex sets, which became a standard method in game theory and mathematical economics. Atticus show a trusting attitude, which he is the most courageous character I know, because of his defence of Tom Robinson. Everything Atticus is doing for Tom Robinson is a step to change the life of the Maycombs town and toward the African American people, not by the charge of skin colour but also fair and equal rights to the community, and give same respect. Atticus is a character who display various form of courage, also show most courageous attitude out of all character. The Evolution of the Automobile Essay The official definition of an automobile is ââ¬Å"a passenger vehicle designed for operation on ordinary roads and typically having four wheels and a gasoline or diesel internal-combustion engineâ⬠(Merriam-Webster 51). There is no one person accredited for the invention of the automobile, but rather a collection of advancements that evolved into the modern-day automobile (Smith 12). Today, there are approximately 600 million passenger vehicles in existence worldwide, with numbers rapidly increasing in emerging economic ââ¬Å"power countriesâ⬠, such as China and India (Smith 23). A Flemish man named Ferdinand Verbiest introduced the first design for a self-propelled vehicle in 1672, in China, nearly one hundred years before the first internal combustion engine (Smith 25). From the late seventeenth century to the early nineteenth century, a series of vehicles, all propelled by steam, were constructed and demonstrated worldwide (Smith 34). The steam car was a superior machine in the nineteen hundreds (Smith 34). Steam cars were responsible for everyday travel, commercial transportation and even held land speed records (Smith36). It wasnââ¬â¢t until 1807 that the worldââ¬â¢s first internal combustion engine was created, in France, by Nicephore Niepce (Smith 36). Another leader in the creation of the internal combustion engine was Francois Issac de Rivaz, who revolutionized the fuel that the engines ran on (Smith 36). Early automobiles powered by internal combustion engine ran on fuel made of powered and coal mixed with oil or a mixture of elements, such as hydrogen and oxygen (Smith 36). In 1824, and Englishman named Samuel Brown adapted the steam engine to burn gasoline and created the first gas vacuum engine (Smith 38). Sir Dougald Clerk, of Scotland, was accredited in 1876 for designing the first successful two-stroke engine (Smith39). In 1890, Wilhelm Mayback created the first four-cylinder, four-stroke engine (Smith39). Everything changed in 1885, when vehicle engineering took a sharp turn towards the future in regards to efficiency and affordability, thanks to the German inventor, Karl Benz (Smith 49). As the market for economical automobiles in the late nineteenth century began to grow, the need for industrial production was pressing. Benz patented the first four-stroke engine to be placed in his companyââ¬â¢s production automobiles in 1888 (Smith 50). The first large-scale assembly production lines appeared in the early 1900s, many of which are still around today (Smith 24). Oldsmobile and Ford were two of the first companies to successfully mass-produce vehicles to meet the vast automotive market needs. American entrepreneur, Henry Ford, invented and improved the assembly line and installed the first conveyor belt system in his automobile manufacturing plant, based in Detroit, Michigan (Smith 95). Assembly lines reduced production costs by training workers to become experts with one specific part of the automobile or machinery, thus reducing production costs (Smith 97). Ford introduced the Model T in 1908, which could be assembled in an unprecedented ninety-three minutes. In the twentieth and twenty-first centuries, governments began to create and enforce automobile safety and environmental regulations (Smith 103). The World Forum for Harmonization of Vehicle Regulations is a working party of the United Nations Economic Commission for Europe (UNECE), the goal of this organization is to facilitate international trade by creating a uniform model of regulations for vehicle design (Corbett 67). The UNECE is also responsible for creating and enforcing regulations on vehicle safety among automotive manufacturers (Corbett 69). According to the World Health Organization (WHO), more than one million people are injured or fatally wounded on the worldââ¬â¢s roads annually (Corbett 70). Some examples of vehicle regulations include seat belts, air bags and laminated windshields (Corbett 71). Seat belts limit the forward motion of the driver or passengers and absorb kinetic energy by stretching to retain movement if an accident occurs (Corbett 71). Air bags inflate to cushion to cushion the impact of the vehicle occupants and are placed in various locations in the vehicleââ¬â¢s interior, such as steering wheels, dash and doors (Corbett 71). Laminated windshields are designed to remain in one piece when impacted to prevent shattering, while maintaining visual clarity just after an accident has occurred, allowing the driver to safely redirect themselves from harmââ¬â¢s way (Corbett 71). There are also regulations for vehicleââ¬â¢ side windows and back windshield (Corbett 72). Windows and rear wind shields must be manufactured with tempered glass, which breaks into granules with minimally sharp edges, rather than splitting into jagged fragments as ordinary glass does (Corbett 72). Many new luxury features, such as paint color choices, differences in interior and upgraded designs and environmental features much as electric or hybrid engines in the twentieth century emerged on the market (Anderson and Anderson 167). The modern day automobile is a vehicle of evolutionary change and has transformed exponentially over the last several centuries. Today, the leading manufacturers of automobiles are Toyota (Japan), General Motors (USA), Volkswagen (Germany) and Ford (USA) (Corbett 22). These leading manufacturers all embody features and characteristics that make their product and branding unique and memorable, as well as abiding by worldwide government standards which include regulations of vehicle safety, environmental protection, energy efficiency and theft resistance (Corbett 13-16, 18). The evolution of motor vehicles from the seventeenth century to present-day is astounding. It would be reasonable to argue that the automobile is the single most evolved piece of modern machinery of all time. Motor vehicle usage has evolved over time, beginning with use for personal leisure and developed for commercial transportation, public transit and racing. The transformation of production and assembly, as well as the addition of customizable features mark the individualistic ideals of the twenty-first century. There no doubt, motor vehicles will continue to evolve throughout time with environmental needs at the forefront worldwide and the ever-growing necessity of increasing luxury among automobile owners. Amartya Sen The Idea Of Justice Review Philosophy Essay Justice is the quality of being just or fair. Justice can also be looked upon as the judgment involved in the determination of rights and the assignment of rewards and punishments. Justice can also be the concept of moral rightness based on ethics, rationality, law, natural law, religion, fairness, or equity (Princeton Web 2010). Individuals may look at justice many different ways, but what factors play into deciding what truly is justice? Must you look at fairness in order to be just, must you look at rationality, or even equality and liberty? There will always be debates about how to achieve justice. But due to so many factors being involved, we may never understand what justice truly is. I believe that in order for one to be just, or even to make a just decision on a matter that factors such as rationality, fairness, human rights, and the well being of all parties involved must be taken into account. But this is just my opinion many of todays philosophers often argue what it mean s to be just or even to achieve a completely just state in our society, along with the decisions we make on a daily basis. To call attention to a specific philosopher, Amartya Sen undoubtedly makes a solid stance on what justice truly means. The Idea of Justice is Amartya Sens assessment of political philosophy. He explores what justice really means and has come up with alternatives to the existing model. Sens philosophic arguments are shown by an exceptional set of stories drawn from literature, history, and current events occurring in our society today. There are not many main thoughts of the book, but the thoughts presented are revisited throughout each chapter, to help the reader see the bigger picture. You must be able to examine each idea Sen presents in his text, as they all come together, when being able to achieve complete justice. Although justice may never fully be reached entirely in any society, Sen does an amazing job giving examples and putting each of his arguments in basic text, so that it is easy for the reader to understand what he is talking about. The specific philosophic arguments of the book are highly important when it comes to the ideas of justice. The Idea of Justice is divided into four main pa rts. Part one contains several of Sens most important thoughts throughout the book. They include, reason objectivity, institutions persons, voice social choice, impartiality objectivity, and closed open impartiality. In part two, forms of Reasoning, Sen discusses a number of themes including rationality, plurality of impartial reasons, and rationality other people. Part three contains information on the capabilities approach, lives, freedoms capabilities, and equality liberty. The final part of Sens text speaks to public reasoning democracy, including sections on justice the world, human rights global imperatives, the practice of democracy, and democracy as public reason. Throughout each of these main sections Sens argues very strong points, I will try to give you a summary of the main points throughout each chapter of Sens book along with where he stands on certain topics and how I can relate and feel about what he believes. To call your attention to the preface/introduction, Sen specifically states that what he is presenting here, is a theory of justice which aims to clarify how we can proceed to address questions of enhancing justice and removing injustice, rather than to offer resolutions of questions about the nature of perfect justice (Sen IX). The Introduction elaborates on two approaches to justice, which include the comparativist framework the social contract framework. The comparativist framework is presented using the realization comparison approach. The realization approach prioritizes the social understanding of advancing justice and removing injustice in real societies with their existing institutions. The social contract framework is presented using the transcendental institutionalism approach which was led by the works of Thomas Hobbes. The transcendental institutionalism approach concentrates on perfect justice and the institutions that would be recognized in such a perfectly just societ y. There are two distinct problems indentified here which Sen engages. First it concentrates its attention on what it identifies as perfect justice, rather than on relative comparisons of justice injustice (Sen 6). Sen goes on to explain that this approach tries to only identify social characteristics that cannot be transcended in terms of justice, and its focus is thus not on comparing feasible societies, all of which may fall short of the ideals of perfection. Also it is intended to identify the nature of the just, rather than finding an alternative being less unjust than another. The second major issue with this approach is described by Sen Saying that in searching for perfection, transcendental institutionalism concentrates primarily on getting the institutions right, and it is not directly focused on the actual societies that would ultimately emerge. We need to focus on how change within the actual society is going to be completed, not by getting institutions perfect to the point that they are just institutions. This would do nothing for emerging societies we need to look at society as whole in order to achieve perfect justice by not having only perfectly just institutions. People are sti ll going to act how they choose as well as behave how they choose, so we must focus on society as whole. The nature of the society that would result from any given set of institutions must, of course, depend also on non-institutional features, such as actual behaviors of people and their social interactions (Sen 6). I do agree with Sen in this theory of justice, it should first and foremost, serve as a basis for practical reasoning. Chapter one is to defend a notion of objectivity in our average thoughts of justice.Ã Sen argues for the idea that we should understand reason as the final judge of our ethical beliefs. One must be able to justify and understand his reasoning by critically evaluating reasoning for ethical beliefs. The necessity of relying heavily on reason is important as Sen describes in his work. Sen says, the case for reasoned scrutiny lies not in any sure-fire way of getting things exactly right (no such way may exist), but on being objective as we reasonably can (Sen 40). Sen believes that one must be able to rely on reason in order to fully justify and decide on our ethical beliefs. I must agree with Sen on this point, when he argues that this approach is not going to be one that will allow and individual to get things exactly right, but allow us to be as objective as we possibly can. By scrutinizing your own reasoning, it is highly probable that you will arrive at the best possible ethical decision. We should not get caught up in being overconfident in the decisions of our own reasoning, as this could add flaws to our decisions. The remedy for bad reasoning lies in better reasoning, and it is indeed the job of reasoned scrutiny to move from the former to the latter (Sen 49). This quote explains it all, it is imperative that one must critically scrutinize his/her own reasoning for a decision, and that without this scrutiny theres great chance for bad reasoning. To avoid this, one must critically scrutinize his/her reasoning of choice or decision. Moving to another argument from Sen, I share the following quote. Justice is rooted in fairness and fairness can be broadly be seen as a demand for impartiality (Sen 54). In order for one to be completely just, the decision must be rational and fair, if a decision is not looked upon as being fair for all parties, you arrive at issues of impartiality. Sens gives his example of three children and a flute, all children having a rational reason as to why they deserve the flute. But if there is not a common vested interest on one solid set of principals between all parties, we run into an issue of what the true just decision is. Institutionally, we cannot address such issues as these. Individuals still have their own morals and values and going to make their own decisions regardless of what is taught. One of the most difficult things is to change an individuals moral values and beliefs, institutionally this cannot be done. Values as these are usually learned at the home-base from parents and guardians and are instilled in us from a very young age. It i s imperative that we do not look at what truly is a just society in order to achieve a just society. As actions such as these will get our society nowhere Sen looks at the social choice theory as an approach to justice as well. Social choice theory is concerned with the relationships between people, their preferences social choice. For example a group of individuals such as a committee making a decision in a voting process, individuals in the group may have different preferences over options that are available to them. This approach deals with the principles of aggregations of preference. Aggregation of social choice may be impossible if the process of choice is to satisfy a set of reasonable conditions. With such reasonable conditions, this could alter the general consensus of a social choice being made by such a committee or group. Even some very mild conditions of reasonable sensitivity of social decision to what the members of society want cannot be simultaneously satisfied by any social choice procedure that can be described as rational and democratic (Sen 93). We can however, become more informally sensitive, if we choose to jus t try and do better rather than to meet the criteria of being fully rational or just. One may use social choice theory as a framework for reasoning, rather than to try and use it completely to achieve justice. Position of observation and knowledge is another important approach Sen discusses in his work. What we observe depends on our position by means of the things that we observe. What individuals decide to believe is based on what we view. How one decides to act relates to his/her beliefs on a particular subject. Observations, beliefs, and actions are vital to understanding and arriving at sensible reasoning. To Sen, Objectivity is a position-dependent phenomenon (Sen 157). This issue [positionality] is quite important for the formulation of a theory of justice and, more specifically, for exploring a theory that gives a special role to public reasoning in the understanding of the demands of justice (Sen 167). It is important here to understand that there is no single way to master a way of making sense of the world or our experience in it. No decision made could ever be rationalized in every single persons mind, something such as this is physically not possible. There are just too many d ifferent people in our society today for that to be able to happen. There will always be a flaw in certain reasoning in some persons view. There is just no way, that every single person in the world would be satisfied with a decision, because we all observe, understand, and put reason into different perspectives. Some placing more weight on rational choice, critical scrutiny, positional objectivity, reasonable behaviors sustainable reason when it comes to making a decision. There are just too many approaches for everyone to be able to agree. So we must take into account all perspectives of others when it comes to justice and just decision making, as Sen states, we must be sensitive to others (206). Respect of others views is exceedingly important here. To move forward, the capabilities approach is also a major theme within the work. The capabilities approach focuses on human lives, and not just on the resources people have, in the form of owning or having use of objects of convenience that a person may possess (Sen 253). The approach emphasizes purposeful capabilities substantive freedoms, such as the ability to engage in economic transactions, or participate in political activities. Poverty is understood as capability deficiency in Sens view. The emphasis is not only on how human beings actually operate but also on their having the capability to do so, which is a practical choice, to operate in important ways if thats what they choose to do. Someone could be stripped of such capabilities in many ways. Ignorance, government oppression, lack of financial resources, and false comprehension, are ways in which one may be stripped of such capabilities. Possession of capabilities strongly implies a responsibility for making use of the m to help others when possible, especially when it comes to the less fortunate. If someone has the power to make a difference that he or she can see will reduce injustice in the world, then there is a strong and reasoned argument for doing just that (Sen 271). If you can see that your capabilities go beyond that of the less fortunate by any means, and that they can be used in any positive manner weather be financial or emotional, I believe that there is no doubt that one should be obligated to reduce injustice in some way shape or form if at all possible. Again this only being an approach, this is not the end all-be all in deciding justice, but undoubtedly can make a difference, and I would have to agree. In basic terms, if you are capable, than you should do something to reduce injustice. I dont feel that you are obligated to do so, but any reduce in injustice, is a step in the right direction. Sen goes on to support the idea that democracy is a universal value, he differentiates between the institutional structure of the contemporary practice of democracy, which is largely the product of European and American experience over the last few centuries (Sen 322-323). In my opinion, one should not assume that because a particular type of institutional structure is up and running, such as elections, voting being counted properly, and etc, that a satisfactory level of democracy has been achieved. Sen believes that having too much institutional focus on democracy has caused particular trouble at the global level. Sen believes that, an uncont rolled media is important to the operation of democratic societies. Sen explains in the text that this contributes to human security by giving a voice to the defenseless and deprived by subjecting the government to criticism from such individuals. I believe this power is key I giving people courage, power, and the ability to express feelings towards actions that are being taken. We sort of put power in the hands of individuals who are not as capable as other, which I do agree with also, because this is a simple way in which we can empower individuals to voice opinions in a manner which may not fall on death ears as usual. We can place emphasis on individuals human rights here, which an important factor concerning human rights is to protect individuals freedoms, thus freedom of speech freedom of press being highly important. Sen says that human rights are moral rights, strong ethical pronouncements as to what should be done (357). According to Sen, reasoning concerning justice should not be restricted to one state or population, but rather be global. If the importance of public reasoning has been one of the major concerns of this book, so has been the need to accept the plurality of reasons that may be sensibly accommodated in an exercise of evaluation (Sen 394). We must look at every possible angle that the book discusses in order to find an answer to the idea of what justice truly is. If you cannot effectively rationalize all aspects of the idea of what justice is, it will be difficult for you to be able to ever understand what justice is. As Sen states the reasons may sometimes compete with each ot her in persuading us in one direction or another in a particular assessment, and when they yield conflicting judgments, there is an important challenge in determining what credible conclusions can be derived, after considering all argument (Sen 394). Which I most certainly agree with, it would in fact be a difficult task to determine a credible solution, but it is imperative that you must consider all of the arguments at hand.

Failures in Death of a Salesman by Arthur Miller Arthur Miller develops a number of significant and central themes throughout the play using techniques such as characterization, setting and language. The best explored theme in the play is the theme of failure and disappointments. 'Death of a Salesman' is a modern day play about a salesman, Willy Loman, his life and his failures in a success driven society and world. He is a victim of "The American Dream" destroyed by false promises and ideals. As the play unravels we realize that he more than just a financial failure but also socially, personally and morally. These failures and faults are not only confined to him but they rub off on his family. The storyline shoots from present day to past throughout the play this does not affect the theme of Failure very much but helps us understand and realize how these failures came about. Willy's entire life is a succession of missed opportunities and chances, and he considers himself a failure because of it. At the beginning of Act 1 we see him failing to make the drive to his business appointment, so he's going to miss out on making a sale because of it. So our first impression of the man is him failing to deliver. As the play proceeds we see Willy comparing himself to his relations or friends realizing that he is even more of a failure. Willy is a failure when compared to his father. Ben asserts "that he could sell more in a week than Willy could in a lifetime". He is represented as someone who was successful in his own way as Ben tells us: 'Great inventor, father. With one gadget he made more in a week than a man like ... ... could not handle it so commits suicide. This is interesting as his death was a financial failure too as life insurance does not cover suicide. His funeral was a failure because no one apart from his close family Charlie and Bernard came. So no matter how sad it sounds but Willy Loman's life was an entire failure. Until this day Willy Loman is a symbol of failure because of society's false value system. This play is based the mid 20th century when success was achieved through hardwork and industry and wit and charm would not earn you a living and this is the main reason Willy Loman failed in life. The play is one of the great tragedies and is a very depressing experience for the audience. No matter how much Willy deserved to fail because of his poor value and morality we cannot but feel sorry for this confused man.

Closing Case: Nicolo Pignatelli and Gulf Italia Essay
What should Pignatelli do? What would you do and why? In this situation, Pignatelli should go with his second option: asking his more influential partners to pressure government officials to quickly grant the two needed permissions. If his partners are unsuccessful then he should play it straight and try to gain government authorization. This is his best option because it is much less threatening to his company and personal reputation than committing bribes would be. Even though playing it straight would likely take several months and possibly years before the government authorizations could be obtained, it is still the best, and most ethical, option in the long run for the company since his refinery will be still able to eventually flourish and be successful. If he were to bribe the government officials or hire the consultant he would be putting his company and reputation on the line. If either of those plans were to fail, he would be exposed to the public and his reputation and business would become corrupt. It is best that Pignatelli do things the morally correct and most ethical way in order for his business to properly prosper. I would do the same as Pignatelli because it is the most ethical decision that benefits myself, my shareholders, and my employees throughout the long run. Either of the other two options are much to unethical and risky for me to choose. I would want my company to be successful and not have anything to hide from the public. Pignatelli seems to be leaning in the direction of hiring a consultant who might use part of the money for bribes. If Pignatelli does not pay the bribes directly, does this absolve him of responsibility? It does not absolve Pignatelli of responsibility since he made the decision to hire the consultant knowing that the money would be going towards a bribe in his favor. If the consultant he hires happens to leak word to the media or government officials that Pignatelli was the source of the bribe, then he would be in a lot of trouble and his refinery would be on the line. Even though he was not the one to physically transfer the bribe money, just having his name linked to the bribery would threaten his very career. Bribes are illegal in Italy. Even if bribes were common practice there, would this justify paying them? No, just because bribes are common practice in Italy does not mean Pignatelli is justified in paying them. Bribery is still considered illegal and can get him in trouble with the law and threaten his employment. The government fosters unethical behavior, such as bribes, through the Foreign Corrupt Practices act, which monitors everything that Pignatelli does to ensure that he does not commit illegal acts. If Pignatelli complies with the laws set by the government then all should be well with him and his refinery. Does Pignatelli have a responsibility to Italian citizens to build an environmentally friendly refinery above and beyond what the law requires? Is it appropriate for Gulf to spend this extra money and essentially take it away from shareholders? No, Pignatelli does not have a responsibility to Italian citizens to build an environmentally friendly refinery above and beyond what the law requires. According to Alex Smithââ¬â¢s conclusion from nearly 200 years ago: ââ¬Å"the best way to advance the well-being of society is to place resources in the hands of individuals and allow market forces to allocate scarce resources to satisfy societyââ¬â¢s demandsâ⬠(pg 37). If Pignatelli does not follow societyââ¬â¢s demands in terms of environmental impact, safety, and many other issues, then he may be forced out of business. So if the Italian society demands an environmentally friendly refinery, it is in Pignatelliââ¬â¢s best interest that he build one, which deems it necessary for Gulf to spend the extra money, taken from the shareholders, to put towards building a refinery that satisfies the demands and values of the Italian people. The social responsibility perspective argues that society grants existence to firms. Under this perspective it is best for managers to provide a return of capital to shareholders while also meeting the demands of society in order to be socially responsibly and continue to exist within a society. How would you feel if you were a lower-level employee in the company and learned that Pignatelli intended to pay bribes to get things ââ¬Å"debottleneckedâ⬠? What would your ethical obligations be? Should you ignore the situation or confront Pignatelli? Should you inform your direct boss or go to the media? If I were a lower-level employee in the company and learned that Pignatelli intended to pay bribes to get things ââ¬Å"debottleneckedâ⬠in the company, I would feel indifferent about the situation since I know it is an illegal and unethical thing to do, yet it is being done in order to save the refinery from hutting down and losing millions of dollars so it is providing me a higher chance of keeping my job. Even though I know it is extremely unethical for Pignatelli to do this, I would not confront him or go to the media because I did not have a direct responsibility in making the unethical decision. Knowing what Pignatelli did wrong will make me feel guilty but I will be forced to ignore the situation since the pros outweigh the cons in terms of me keeping my job, the company continue running, and Pignatelli getting his initial 6 million ton capacity permitted by the government. I should not inform my direct boss or go to the media because I wouldnââ¬â¢t want to be the whistle-blower in this case and be responsible for a company shutting down and people losing their jobs. If Pignatelli were to get caught for his bribe on his own, then I, a lower-level employee, would not be blamed for the situation in any way due to the concentration of effect and proximity level between me and Pignatelli.

Maju Jaya Supermarket (MJ Supermarket) advertises in the newspapers that there is a vacancy for the post of manager. The advertisement stated that those who are interested can come anytime to MJ Supermarket for an interview from 11th April 2014 until 21st April 2014. Ahmad who was very interested with the post came to MJ Supermarket on 20th April 2014 and was informed by the owner that the post was already filled. Ahmad was very angry as he has already tendered his resignation to his former company. On the day that Ahmad came to the MJ Supermarket, he saw Mr Chan, his neighbour, entering the MJ Supermarket and selected some canned food, shampoo, eggs and vegetables. He put all the items into his trolley. However, while he was still looking for other items, Mr Chan received a call from his son asking him to pick him up from the train station. Mr Chan left the items in the trolley and went out from the MJ Supermarket. Advise Ahmad and Mr Chan whether there is any contract between them and the MJ Supermarket. (20 MARKS) ANSWER to Part A (Ahmad Case) Introduction The definition given under the Section 2(h) of the Contracts Act 1950 is that a contract is an agreement enforceable by law (The Commissioner of Law Revision, 2006). Therefore in the Ahmadââ¬â¢s case, one of the parties (Ahamd or MJ Supermarket) has to make an offer that is duly accepted by the other. Issue First issue that we need address in this case is to see whether the advertisement stating the interview deadlines contains an offer. If it does, can Ahmadââ¬â¢s willingness to attend the interview be considered as an acceptance of the offer? In case the advertisement is not considered as an offer, or if it is just an invitation to treat, then there is no contract between them. Second issue raised by the question is whether Ahmadââ¬â¢s presence in the MJ Supermarket to attend the interview on time, after his resignation from his previous job, is an offer. In that case, does MJ Supermarket can reject Ahmadââ¬â¢s offer? Based on the limited information given in the Ahmadââ¬â¢s case, the issues were analysed to see whether there is a contract between both parties? The Law According to Section 2(a) of the Contracts Act 1950, an offer exists ââ¬Å"when one person signifies to another his willingness to do or to abstain from doing anything, with a view to obtaining the assent of that other to the act or abstinence, he is said to make a proposalâ⬠(Rahman , 2011). As given in the Carlill v. Carbolic Smoke Ball Co Ltd (1893) 1 QB 256 case, a proposal or an offer can also be made to the general public to be accepted by any person who knows about it and willing to perform the requirements of the proposer. On the other hand, an invitation to treat can be defined as giving information or requests to others to make offers. Application of the Law to the Facts of the Problem The advertisement by the MJ Supermarket clearly states that those who are interested can come anytime to MJ Supermarket for an interview from 11th April 2014 until 21st April 2014. This raise the question whether the advertisement is intended to bound in contract with the participants who come for the interview. In case of COELHO v. THE PUBLIC SERVICES COMMISSION[1964] M.L.J.12, the applicant, a Health Inspector under the Town Board, Tanjong Malim, applied for the post of Assistant Passport Officer in the Federation of Malaya Government Oversea Missions advertised in the Malay Mail dated 19 February 1957. Consequently, the applicant was informed that he was accepted and, after undergoing training, he was posted to the Immigration Office, Kuala Lumpur, where he remained until December 1958 when he was transferred to the Immigration Office at Johor Bahru (Rahman , 2011). The High Court ruled that the newspaper advertisement was an invitation for qualified persons to apply and the applications were treated as offers. Same can be expressed to the case of Ahmad that the newspaper advertisement by the MJ Supermarket is an invitation to those who are interested to participate in the interview. In the case of Gibson v Manchester CC [1979] 1 All ER 972, HL local council write to tenants inviting them to apply to purchase their homes. One such tenant P did apply, and a price was agreed. Following a change of party control, the new council DD refused to go ahead with the sale. The House of Lords said there was no binding contract: P had made an offer which DD had not yet accepted. Phrases in the correspondence such as ââ¬Å"may be prepared to sellâ⬠and ââ¬Å"please complete the enclosed application formâ⬠were indicative of an invitation to treat (Thomsonà Reuters, 2004). Similarly to this case, the advertisement by the MJ supermarket stated th at those who are interested ââ¬Å"can comeâ⬠any time to the interview is crucial to consider that the advertisement was a step in the negotiation for a contract. Conclusion Considering the court ruling on both Coelhoââ¬â¢s case and Gibsonââ¬â¢s case, the advertisement made in the newspaper was an ââ¬Å"invitation to treatâ⬠. However, the presence of Ahmad to participate in the interview is considered as an offer. The MJ Supermarket rejected this offer. Therefore the advice to Ahmad is that there is no contract between himself and the MJ Supermarket. Does he or MJ Supermarket fulfil the requirements of a contract? In the Contracts Act 1950, Section 4(1) states that the ââ¬Å"communication of a proposal is complete when the proposal comes to the knowledge of the person to whom it is made. To fulfil the pre-conditions of a contract, the proposal should be clearly communicated to the acceptor. Under Section 5(1) of the Contracts Act 1950, ââ¬Å"a proposal may be revoked at any time before the communication of its acceptance is complete as against the proposer, but not afterwards. Application of the Law to the Facts of the Problem Mr Chan took goods by himself suggests that there is a display of goods in the MJ Supermarket and allows customers to voluntarily pick goods they like and purchase from the counter. ââ¬Å"In the case of Fisher v Bell [1960] 3 All ER 731, DC it was a statutory offence under the Restriction of Offensive Weapons Act 1959 to offer for sale any of various items, including flick-knives. A Bristol shopkeeper R displayed such a knife in his window, with a ticket reading ââ¬Å"Ejector knife ââ¬â 4s.â⬠[4 shillings = 20p], and was prosecuted for an offence under the Act. The Divisional Court took a literal interpretation of the statute and said he had committed no offence: the display was an invitation to treat, not an offer to sellâ⬠(Rahman , 2011). In relation to the Mr Chanââ¬â¢s scenario, this case can be used to justify an argument of changing mind at any point of purchase before a contract is made. Therefore Mr Chanââ¬â¢s decision to leave the goods without buying is acceptable based on Fisherââ¬â¢s case. ââ¬Å"In the case of Pharmaceutical Society v Boots [1953] 1 All ER 482, CA certain products that were to be sold only under the supervision of a registered pharmacist were displayed on shelves in a self-service shop. The Pharmaceutical Society of Great Britain (who are responsible for enforcing this legislation) brought a prosecution against the shop for allowing customers to buy these products by helping themselves, but the Court of Appeal (upholding Lord Goddard CJ) said they had no case. The customer having selected the goods made an offer to purchase when he took them to the cash desk, and there was a registered pharmacist supervising that point at which the sale took placeâ⬠(Rahman , 2011). Mr Chan does not take the goodsà to the sales counter. In the case it is also mentioned that he was still looking for goods to purchase. However, he revoked from the process of making an offer to the sales staff when he got a phone call. As mentioned in the Boots case, the action by Mr Chan indicates that he did not properly complete an offer to purchase. In other words, he was involved in an invitation to treat from the MJ Supermarket. Conclusion To complete a contract between Mr Chan and MJ Supermarket, there is should clear communication of an offer and acceptance between both parties. Based on the discussed cases above, the display of goods are considered as an invitation to treat. Mr Chan does not complete an offer to purchase the goods as he quit his process of purchasing in the middle before taking goods to the sales counter. Futhermore, the MJ Supermarket does not have knowledge of a possible offer from Mr Chan.
